1. Acceptance of Terms
By accessing or using ITBABA's services, including the FieldForce SaaS platform, you agree to be bound by these Terms of Service. If you do not agree, do not use our services. These terms constitute a legally binding agreement between you and ITBABA.
2. Services Description
ITBABA provides IT services including website development, custom software, and FieldForce — a multi-tenant SaaS platform for field staff GPS tracking, attendance management, CRM, and WhatsApp Business API notifications.
3. Account Registration
You must provide accurate, complete information when registering. You are responsible for maintaining the confidentiality of your account credentials and all activities under your account. You must notify us immediately of any unauthorized use.
4. Subscription and Payment
FieldForce is offered on a subscription basis. Payments are processed via Razorpay. Subscriptions renew automatically unless cancelled. Prices are in Indian Rupees (INR) and include applicable GST. No refunds are provided for partial months.
5. WhatsApp Business API Usage
Use of WhatsApp Business API through our platform is subject to Meta's WhatsApp Business API Terms of Service. You agree to use WhatsApp notifications only for legitimate business communication and not for spam or unsolicited marketing. You must obtain proper consent from recipients before sending messages.
6. Data and Privacy
Your use of our services is also governed by our Privacy Policy. You retain ownership of your business data. By using our services, you grant ITBABA a limited license to process your data to provide the services.
7. Acceptable Use
You agree not to: (a) use services for illegal purposes; (b) violate any applicable laws; (c) attempt to gain unauthorized access; (d) transmit harmful code; (e) abuse the WhatsApp API; (f) resell services without authorization.
8. Service Availability
We aim for 99.5% uptime but do not guarantee uninterrupted service. Scheduled maintenance will be notified in advance. We are not liable for downtime caused by third-party services (Google Maps, WhatsApp API, Razorpay).
9. Limitation of Liability
ITBABA's liability is limited to the amount paid for the service in the 3 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.
10. Termination
We may terminate your account for violation of these terms with or without notice. You may cancel your subscription at any time. Upon termination, your data will be retained for 30 days before deletion.
11. Governing Law
These terms are governed by the laws of India. Any disputes shall be subject to the jurisdiction of courts in Muzaffarpur, Bihar, India.
